9/11 Compensation Claims for Downtown Manhattan Residents

Financial compensation for economic (medical expense, lost earnings, etc.) and noneconomic (pain and suffering) losses are available not only to the World Trade Center (WTC) first responders and recovery workers but also to downtown civilians – most all Downtown Manhattan residents and those who worked or were students south of Canal Street between 9/11 and May 30, 2002.

Compensation is provided by the September 11th Victim Compensation Fund (VCF) and includes noneconomic (pain and suffering) as well as economic losses such as loss of wages and fringe benefits, out-of-pocket medical expenses, loss of household services, and, in cases of death, funeral expenses and an additional award of $100,000 for a surviving spouse and for each dependent.

Downtown Manhattan Residents Breathed the Same Toxic 9/11 Air as Responders

In addition to the first responders, the Downtown civilians – residents, workers, students, and visitors – also found themselves caught in the toxic fallout caused by the 9/11 attacks. Those who lived in the Downtown area (south of Canal Street) were exposed to toxic substances in the cloud of dust and debris created by the attacks, including asbestos, lead, toxic dust, glass fibers, metals, silica, concrete, and various other carcinogens that were part of the WTC dust. Presence in the 9/11 VCF Disaster Area (lower Manhattan south of Canal Street) or the larger area that makes up the WTC Health Program NYC Exposure Zone, has been linked to many chronic health conditions, including an increased risk of various and most any type of cancer, respiratory ailments, aerodigestive disorders, and mental health issues such as PTSD.

The realization that the fallout from the tragic events of 9/11 has extended far beyond Ground Zero to affect the health and well-being of a broader population of Manhattan residents serves as a poignant reminder of the enduring impact of that day. If you fall into this category and have concerns about your health, contacting the World Trade Center Health Program (WTCHP) for guidance and screening is a critical step in getting the care and treatment you need.

What is the Exposure Zone?

The Exposure Zone or Disaster Area is defined as the area in which individuals were exposed to the toxic dust cloud, smoke and other harmful chemicals resulting from the 9/11 terror attacks.  There are two different geographical areas involved: The WTCHP defines the NYC Disaster Area as the 1.5 mile area from the WTC site that includes all of lower Manhattan south of Houston Street, Governors Island, and parts of downtown Brooklyn including Brooklyn Heights and Dumbo. The 9/11 VCF Exposure Zone is smaller than the WTCHP Disaster Area and does not include any part of Brooklyn and in NYC encompasses all of lower Manhattan but only as far north as Canal Street, East Broadway, and Clinton Street. Also included in the 9/11 VCF Exposure Zone is the Pentagon crash site, the crash site in Shanksville, Pennsylvania, and the NYC disaster area plus extended coverage for individuals who were involved in rescue, recovery, and debris removal efforts related to the attacks in any area related to or along the routes of debris removal, such as barges, morgues, and the Fresh Kills landfill.

We Represented a Battery Park Area Resident

We represented a Battery Park area resident who was diagnosed with breast cancer, which required a double mastectomy. They were able to win her $1.1 million in tax-free 9/11 Fund payouts from the Victim Compensation Fund. This award brought small relief to the client, however, who was suffering tremendously from the exposure she experienced while in her own home.

Health Conditions Common for a New York City Resident Post-9/11

Post-9/11, downtown Manhattan residents have faced numerous health problems. They encompass a range of cancers, respiratory diseases, and mental health conditions that continue to affect thousands of people.

  • Cancer: Over 70-plus different types of cancers, including prostate cancer, lung cancer, thyroid cancer, and leukemia, have been directly connected to exposure to the WTC dust. Long-term studies and continuous monitoring by the WTC Health Program (WTCHP) have revealed that the risks are not confined to the immediate aftermath, as many who were exposed to the toxic substances in the months after the event have been diagnosed with cancer in the decades since 9/11.
  • Chronic Obstructive Pulmonary Disease (COPD): The 9/11 dust caused new or exacerbated Chronic Obstructive Pulmonary Disease (COPD) for many individuals exposed, leading to a persistent cough, shortness of breath, and other respiratory symptoms. COPD remains one of the most common and debilitating conditions linked to the WTC dust.
  • Post Traumatic Stress Disorder (PTSD): The traumatic events of September 11, 2001, led to a significant increase in PTSD diagnoses. The harrowing experiences of that day continue to leave emotional scars that affect survivors’ mental health.

These are only a few examples of the widespread health problems that many downtown Manhattan residents still face today. Understanding the risks and seeking appropriate medical care and support can significantly improve the quality of life for those still living with the legacy of 9/11. If you or a loved one falls into this category, don't hesitate to seek professional medical advice and explore the support services available to you.

Support Available for Downtown Manhattan Residents

The 9/11 James Zadroga Health and Compensation Act established two programs to provide support to survivors and responders, ensuring that victims continue to receive the care and financial support they need.

Victim Compensation Fund (VCF)

The 9/11 Victim Compensation Fund (VCF) was established to provide financial compensation for individuals and families who suffered physical harm or lost a loved one due to the terrorist attacks. Those who lived or worked in the Exposure Zone can file a claim with the VCF to seek compensation for their economic loss as well as losses due to pain and suffering.

World Trade Center Health Program (WTCHP)

The World Trade Center Health Program offers medical monitoring and treatment for those affected by the 9/11 attacks and enrolled in the WTCHP. If you are eligible, you can access comprehensive medical care for 9/11-related health conditions. The WTCHP offers treatment for both physical and mental health issues.
