Financial compensation for economic (medical expense, lost earnings, etc.) and noneconomic (pain and suffering) losses are available not only to the World Trade Center (WTC) first responders and recovery workers but also to downtown civilians – most all Downtown Manhattan residents and those who worked or were students south of Canal Street between 9/11 and May 30, 2002.

Compensation is provided by the September 11th Victim Compensation Fund (VCF) and includes noneconomic (pain and suffering) as well as economic losses such as loss of wages and fringe benefits, out-of-pocket medical expenses, loss of household services, and, in cases of death, funeral expenses and an additional award of $100,000 for a surviving spouse and for each dependent.

Those who lived in the Downtown area (south of Canal Street) were exposed to toxic substances in the cloud of dust and debris created by the attacks, including asbestos, lead, toxic dust, glass fibers, metals, silica, concrete, and various other carcinogens that were part of the WTC dust. Presence in the 9/11 VCF Disaster Area (lower Manhattan south of Canal Street) or the larger area that makes up the WTC Health Program NYC Exposure Zone, has been linked to many chronic health conditions, including an increased risk of various and most any type of cancer, respiratory ailments, aerodigestive disorders, and mental health issues such as PTSD.

What is the Exposure Zone?

The Exposure Zone or Disaster Area is defined as the area in which individuals were exposed to the toxic dust cloud, smoke and other harmful chemicals resulting from the 9/11 terror attacks. There are two different geographical areas involved: The WTCHP defines the NYC Disaster Area as the 1.5 mile area from the WTC site that includes all of lower Manhattan south of Houston Street, Governors Island, and parts of downtown Brooklyn including Brooklyn Heights and Dumbo. The 9/11 VCF Exposure Zone is smaller than the WTCHP Disaster Area and does not include any part of Brooklyn and in NYC encompasses all of lower Manhattan but only as far north as Canal Street, East Broadway, and Clinton Street. Also included in the 9/11 VCF Exposure Zone is the Pentagon crash site, the crash site in Shanksville, Pennsylvania, and the NYC disaster area plus extended coverage for individuals who were involved in rescue, recovery, and debris removal efforts related to the attacks in any area related to or along the routes of debris removal, such as barges, morgues, and the Fresh Kills landfill.

They were able to win her $1.1 million in tax-free 9/11 Fund payouts from the Victim Compensation Fund. This award brought small relief to the client, however, who was suffering tremendously from the exposure she experienced while in her own home.

Health Conditions Common for a New York City Resident Post-9/11

COPD remains one of the most common and debilitating conditions linked to the WTC dust.
Post Traumatic Stress Disorder (PTSD): The traumatic events of September 11, 2001, led to a significant increase in PTSD diagnoses. The harrowing experiences of that day continue to leave emotional scars that affect survivors’ mental health.
