What are the VCF Deadlines?

The September 11th Victim Compensation Fund (VCF) is a federally funded program that was established to provide financial compensation for those affected by the September 11, 2001, terrorist attacks or the debris removal efforts in their immediate aftermath. Those affected may be eligible for compensation for past and future lost wages, compensation for noneconomic loss (“pain and suffering”), and reimbursement for past out-of-pocket medical expenses. To be eligible to file a claim, you must register with the VCF and the World Trade Center Health Program (WTCHP) by the applicable deadlines.
First Step: Registration
A claim with the 9/11 Victim Compensation Fund (VCF) must be registered within two years from the earlier of:
- The date the WTC Health Program most recently certified your health condition as 9/11-related, or
- The date a federal, state, or local government entity (such as the New York Workers’ Compensation
Board or a New York City employer pension fund like FDNY, NYPD, or NYCERS) notifies you that your physical health condition is 9/11-related.
Important Exception:
If you were never enrolled in the WTC Health Program and have not received a finding from workers’ compensation or another government entity, there is no deadline to register or file your VCF claim. Even if more than two years have passed since your diagnosis with a 9/11-related cancer or other condition, you can still register and file a VCF claim.
This is because the two-year registration period only begins when the WTC Health Program (or other governmental entity) certifies a condition. If you have never participated in the WTC Health Program, the two-year deadline has not yet started for you, even if you got sick (or lost a loved one) with a 9/11 cancer or other condition any time during the 20+ years since 9/11.
What is the VCF Claim Filing Deadline?
The “Never Forget the Heroes, James Zadroga, Ray Pfeifer, and Luis Alvarez Permanent Authorization of the September 11th Victim Compensation Fund Act” (“VCF Permanent Authorization Act”) extended the VCF’s Claim Filing Deadline until October 1, 2090. The claim filing deadline is the same for all claims, making it possible for individuals who develop health conditions later in life to seek compensation. The VCF encourages you to file your claim after you have been certified by the World Trade Center (WTC) Health Program for a 9/11-related physical health condition and as soon as the full scope of your claimed losses are known to ensure prompt review of your compensation claim.
What Happens if I’ve Missed My VCF Eligibility Window?
Missing a deadline doesn’t automatically mean you’re ineligible. Exceptions may apply, depending on individual circumstances. For example, if you recently became aware that your condition is related to 9/11 exposure or if new evidence supports your claim, you may still qualify to file a compensation claim.
